Supreme Court strikes down Calif. law prohibiting schools from automatically telling parents if children think they're transgender

In a 6-3 ruling revealed late Monday, the U.S. Supreme Court blocked a California law that prohibits public schools from being required to notify parents when children say they think they may be transgender, delivering a blow to California Gov. Gavin Newsom's progressive agenda. 


California parents and even some educators in the Golden State sued to have the law overturned after some parents say they were misled by their children's schools and aided in allowing their children to begin "transitioning" genders either without their knowledge or over their objections. The Thomas More Society, which represented some of the parents in the appeal, hailed the ruling the "most significant parental rights decision in a generation."


The law that was overturned by the nation's top court was signed by Newsom in 2024, according to Fox News. Newsom and state lawmakers contended children deserve the right to privacy regarding matters of their sexual or gender expression. The Supreme Court's majority agreed with the parents, writing in its opinion, "The parents who assert a free exercise claim have sincere religious beliefs about sex and gender, and they feel a religious obligation to raise their children in accordance with those beliefs. California’s policies violate those beliefs." The court's majority also added that the California law infringes upon Americans' First Amendment right to the free exercise of religion. 


The ruling by the top court aligns with the U.S. Department of Education's position on this issue. Last month, the Education Department declared the California law violates federal law and the department threatened to pull nearly $8 billion in funding to the state. 


Newsom's office issued a statement slamming the decision, saying “Teachers should be focused on teaching — not forced to be gender cops," The Sacramento Bee reported. "Today’s shadow docket ruling by the Supreme Court undermines student privacy and the ability to learn in a safe and supportive classroom, free from discrimination based on gender identity.”
